Anti-spam policy of GET-N-POST Service

The company GET-N-POST not only disapproves of spam but also constantly develops its technology preventing the spreading of spam and other messages that can be considered as unwanted by the user (recipient of newsletters). Nevertheless, we publish this anti-spam policy to avoid any attempts to send out spam using GET-N-POST service capabilities. 

 

Below find an extract from the Federal Law dated 27.10.2008 N 179-FZ "On Advertising": 

 

Article 18. Advertising transmitted via telecommunication networks and placed on postings

 

Transmission of advertising via telecommunication networks including the use of telephone, fax, mobile radio communications is allowed only with a prior consent of the subscriber or recipient to receive advertising. At the same time advertising is recognized as transmitted without prior consent of a subscriber or recipient if the sender of advertising cannot prove that such kind of consent was given. 

 

1. Each client that expressed his/her consent to use GET-N-POST service capabilities explicitly guarantees that each recipient of newsletters had explicitly expressed his/her consent to receive commercial and/or advertising information and confirmed their consent by clicking and following the unique link from the confirmation letter (Double Opt-In).

 

2. Clients that subscribed users via paper forms, telephone calls or other methods that exclude receiving a written consent of using Internet services are obliged to send a letter via post to confirm consent of the user (Double Opt-In).

 

GET-N-POST service is entitled to request paper forms, telephone calls records and any other proof of the initial receipt of subscription consent from such clients. 

 

3. When using GET-N-POST services, which imply uploading a subscriber base, users shall receive a notification letter, which shall be necessarily sent by GET-N-POST. Later on, GET-N-POST will only send newsletters to subscribers that confirmed their consent. 

 

4. Subscriber consent which was expressed (i) by means of filling in and signing a questionnaire that expressly did not refer to the fact that the user would receive any information from the Client by e-mail or (ii) throughout the registration procedure by way of clicking by default the opt-in checkbox, does not amount to an entitlement to transmit newsletters and will be considered as an attempt to spread spam.

 

5. The client which delivers newsletters: 

— with an invitation to subscribe more than twice

— to purchased customer base lists

— to customer base lists built with the assistance of e-mail collectors in the Internet (including social networks)

— with the identical content to numerous customer base lists

— “renting” their customer base

 

is considered attempting to send out spam. Such clients will have their access denied to GET-N-POST service without reimbursement of paid money.  

 

6. The client sending out newsletters of the same or similar kind directly or via other newsletter services can be considered as spreading spam. Such clients may get their access to GET-N-POST services limited or denied without reimbursement of paid money.

 

7. The client undertakes the obligation to specify the following information for a recipient in each newsletter

— the actual location address and phone number of the Client

— the reason of having the user’s e-mail address in the mailing list of the Client

— the possible actions to unsubscribe from any future newsletters from the Client and delete their e-mails from the mailing list (e.g. the link to disable the subscription).

 

8. It is prohibited for the client to delete, disguise and/or obstruct the user in reading the links “Report this newsletter” and “Unsubscribe” that are placed in newsletters directly by GET-N-POST service (unless otherwise expressly provided by the contract). 

 

9. When resolving conflicts GET-N-POST service always supports the end recipient of the newsletter. Therefore, even if a user expressed consent to be subscribed (Double Opt-in) but pressed the “Spam” button in his e-mail interface (service) we consider it as a reputation spoiler for the client and abide by reputational limits set by the major mailing systems, specifically:

— up to 10000 e-mails (per month) - 1,4% 

— up to 500 000 e-mails (per month) - 1,3% 

— up to 10 000 000 e-mails (per month) - 1,1% 

— up to 50 000 000 e-mails (per month) - 0,7% 

— more than 50 000 000 e-mails (per month) - 0,4% 

 

10. The client is obliged to store user information (e-mails, date of subscription, IP-address, URL of the website of subscription) as of the moment of its receipt and provide this information to GET-N-POST service upon request. Refusing to provide such information will amount to sending spam. 

 

11. Eight (8) or more spam occurrences related to newsletters sent from the Client directly or the ones sent via GET-N-POST service (or other services) results in automatic block of access without reimbursement of paid money.

 

This Anti-span policy is mandatory for execution by all Clients of GET-N-POST Service with no exception.
